Hot insurance issues from the US – S2E1
Welcome to The Policyholder Podcast, presented by Fenchurch Law, the podcast that aims to bring insights from a variety of guests with different perspectives on the insurance market, in a way that’s relevant to policyholders, and the brokers who represent them.
In this episode, our host David Pryce welcomes special guest Rob Jacobs, Partner at Blank Rome to discuss hot insurance issues from the US.
Rob represents policyholders in a wide array of insurance recovery disputes arising from product liabilities, toxic torts, first-party property loss, business interruption, advertising liability, professional liability, kidnap and ransom losses, and various directors and officers-related liabilities, to name a few.
Rob has litigated these disputes, when necessary, in courts throughout the United States and also has engaged in various other forms of dispute resolution, particularly domestic and international arbitrations and mediations. Rob is known for his substantial experience representing policyholders in London arbitrations, required under many Bermuda Form and other offshore policies.
In this episode we cover the following:
- The claims that have been impacting the US insurance market over the last couple of years
- The kind of products that have given rise to issues in the US insurance market over the last couple of years
- How a Bermuda Form claim differs from an “ordinary” coverage dispute
- The types of coverage issues that typically arise in relation to Bermuda Form claims
In our “Good, Bad, or Ugly” segment find out why Rob thinks a recent decision from the Californian courts on duty to defend is bad for policyholders.
