The Talks

Workshop on Causation & Aggregation

Insurance policies respond to losses proximately caused by perils insured against. However, identifying the proximate cause of a loss can be challenging, especially in cases of factually complex losses with multiple potential causes.

Similarly, aggregation is one of the most frequent areas of dispute between policyholders and insurers. Unusually, it is also an area where the relevant policy provisions aren’t either obviously “pro-policyholder” of “pro-insurer”.

This interactive session led by David Pryce (Managing Director, Fenchurch Law APAC) and K. Anparasan (Managing Director, WhiteFern LLC) will look (i) in relation to causation, at the principles for determining the “proximate cause” of a loss, and (ii) in relation to aggregation, at the most common ways in which limits of indemnity and deductibles are capable of aggregating, including by reference to “event”, or “originating cause”, or by reference to a “series” of one of those. The audience will then be invited to apply the principles discussed to a selection of case studies.


UK Case Law Update

IThis update by Mark Errington (Partner, Kennedys) and Toby Nabarro (Director, Fenchurch Law APAC) will discuss the most significant UK insurance decisions of recent years that have shaped the insurance market and their impact on insurers, brokers and policyholders, including decisions relating to the meaning of damage and aggregation (Sky UK Ltd v Riverstone Managing Agency Ltd), subrogation (Royal and Sun Alliance Insurance Plc v Textainer Group Holdings Ltd) and various business interruption-related decisions arising from the Covid-19 pandemic.

Through this update, attendees will gain a deeper understanding of the implications of these decisions on the wider insurance market.


Business Interruption in APAC: Panel Discussion

Business interruption claims are rarely straightforward affairs. Join us in a cross-market panel discussion in which insurers, brokers, loss adjusters and forensic accountants will share their views on issues commonly faced when dealing with business interruption claims in the APAC region. The discussion will be moderated by Allister Tan (Founding Director, Siraj Omar LLC).
